These Terms of Use govern your use of the website at agentum.com.au and its related pages, tools and downloadable materials (Site), operated by Agentum Pty Ltd (ACN 691 386 713, ABN 13 691 386 713) (Agentum, we, us). By using the Site you agree to these Terms. If you do not agree, please do not use the Site. Our services are provided only under separate written engagement terms, not under these Terms.

1. Use of the Site

1.1 You may use the Site for lawful purposes only. You must not:

  • interfere with the Site's operation or security, or attempt to gain unauthorised access to any system;
  • scrape, harvest or copy content or data by automated means, including to train or develop AI models, without our written consent;
  • transmit malicious code or unlawful, infringing or harmful material;
  • misrepresent your identity or your organisation; or
  • submit information you are not authorised to provide.

2. Information only, no advice

2.1 Content on the Site, including articles, guides, flyers and interactive tools, is general information only. It is not accounting, taxation, legal, financial product, privacy, regulatory or technology advice, and it does not take account of your circumstances. References to laws, regulatory requirements and third-party products are general and may change. You should obtain advice specific to your situation before acting.

2.2 Outputs of any interactive or AI-assisted tools on the Site are generated automatically, may be inaccurate or incomplete, and are provided for illustration only. Estimates of time savings, costs or benefits are indicative and are not a representation of results you will achieve.

2.3 You are responsible for the information you enter into forms and tools on the Site. Please do not enter sensitive information, or personal information about other people beyond basic business contact details.

3. Our services

3.1 Descriptions of our services on the Site, including session formats and durations, deliverables, turnaround times and example targets, are general descriptions. They are not an offer capable of acceptance. Any engagement is subject to confirming fit and to written engagement terms, which prevail over anything on the Site.

3.2 Example targets and time savings shown on the Site are illustrative. Results depend on your circumstances and are not guaranteed.

4. Intellectual property

4.1 The Site and its content, including text, graphics, logos, software, frameworks and downloadable materials, are owned by or licensed to Agentum and are protected by law. You may view, download and print content for your personal or internal business reference, and you may share our published flyers in unaltered form. You must not otherwise reproduce, modify, distribute or commercially use Site content without our written consent.

4.2 Agentum and the Agentum logo are trade marks of Agentum Pty Ltd. Other names and logos on the Site belong to their respective owners, and their appearance does not imply endorsement.

5. Third-party content and links

5.1 The Site may refer or link to third-party products, services or websites. These references are for information only and are not endorsements. We are not responsible for third-party content, and your use of third-party sites is at your own risk and subject to their terms.

6. Liability

6.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded.

6.2 Subject to clause 6.1 and to the extent permitted by law:

  • the Site is provided as is, and we do not warrant that it will be accurate, complete, current, uninterrupted or free of harmful components;
  • we are not liable for any indirect or consequential loss, or for loss arising from reliance on Site content or tool outputs;
  • where our liability for failure to comply with a consumer guarantee can be limited, it is limited, at our option, to supplying the relevant content again or paying the cost of having it supplied again; and
  • our total liability in connection with the Site is limited to $100.

7. Privacy

7.1 Our handling of personal information collected through the Site is described in our Privacy Policy at agentum.com.au/privacy/.

8. Changes, suspension and termination

8.1 We may change, suspend or discontinue the Site or any feature at any time. We may update these Terms by posting the updated version on the Site, and the date at the top shows when they last changed. Continued use after an update means you accept the updated Terms.

9. General

9.1 These Terms are governed by the laws of New South Wales, and you submit to the non-exclusive jurisdiction of the courts of New South Wales. If any provision is unenforceable, it is severed and the rest continues in force. A failure to enforce any provision is not a waiver of it.
